These Terms of Use is a legally binding agreement made between you and The Trustee for Grey New Family Trust ( “we”, “us”, or “our”), with regards to your access to and use of the https://realgoodhelp.com website as well as any other media form, channel, mobile website or application related, linked, or otherwise connected thereto (collectively, the “Platform”). You agree that by accessing the Platform, you have read, understood, and agreed to be bound by these Terms of Use. If you do not agree with these Terms of use, please discontinue accessing the Platform immediately.

The content of the Platform is not intended for distribution or use in any jurisdiction where such distribution or use would be contradicting the laws or which would require us to register in any way within such jurisdiction. People who access the Platform from other locations do so on their own initiative and are solely responsible for compliance with local laws, if and to the extent local laws are applicable.

The Platform services are not intended to replace traditional forms of face-to-face psychotherapy. You should always talk to an appropriately qualified health care professional for diagnosis and treatment. None of the content on the Platform or provided by the therapists represents or warrants that any particular medication or treatment is safe, appropriate, or effective for you. You should not disregard professional medical advice, or delay seeking it, because of any information contained on this Platform. We do not approve any specific tests, medications, products or procedures. If at any time you believe the Platform services do not meet or address your needs or raises concerns about your overall health, you are advised to seek the services of a qualified health care professional.

Purpose of the Platform

The Platform may be used to connect therapists with clients.

Account Eligibility and Enrollment

You certify that you are legally able to consent to receive the Platform services, and that you are legally able to enter into a contract.

To access the Services, you must sign up and establish an individual user account, which includes providing specific information as set out in the Privacy Policy.

You must not create more than one account, or an account for anyone other than yourself without prior permission from the other person. You also undertake not to use the account of any other person for any reason.

You agree to provide true, accurate, current, and complete information about yourself when registering for an account You are to maintain, and promptly update account information, each time you log on. If you provide any information that is untrue, inaccurate, not current, or incomplete, or we have reasonable grounds to suspect that such information is untrue, inaccurate, not current, or incomplete, we reserve the right to refuse the service to you or take other steps as appropriate.

You are solely and fully liable and responsible for all activities performed using your account. We will hold you liable and responsible for any damage or loss incurred as a result of the use of your account by any person whether authorized by you or not, and you agree to indemnify and hold us harmless for any such damage or loss.

You are solely responsible for maintaining the confidentiality of your Platform account password and username (if any), and any other security information related to your account at all times. We will not be liable for any loss or damage that you incur as a result of someone else accessing your account, either with or without your knowledge. You are recommended to take extra care to protect your password.

Acceptable Use

You hereby confirm and agree that all the information that you provided in or through the Platform, and the information that you will provide in or through the Platform in the future, is accurate, true, current and complete. Furthermore, you agree that you will make sure to maintain and update this information so it will continue to be accurate, current and complete.   • malicious software or code;
  • unlawful, harassing, privacy invading, abusive, threatening, vulgar, obscene, racist or potentially harmful content: you agree not to use this Website to defame, abuse, harass, stalk, threaten or otherwise offend any person
  • any content that infringes a third party right including intellectual property rights;
  • any content that may cause damage to a third party;
  • any material that you do not have a right to make available or which contains viruses, or other computer codes, files or programs designed to interrupt, limit or destroy the functionality of other computer software or hardware or to utilize other computer systems for improper purposes or without authorization;

  • any content which may constitute, cause or encourage a criminal action or violate any applicable law

You agree and commit not to interfere with or disrupt, or attempt to interfere with or disrupt, any of our systems, services, servers, networks or infrastructure, or any of the Platform's systems, services, servers, networks or infrastructure, including without limitation obtaining unauthorized access to the aforementioned. You shall not attempt to gain unauthorized access to any user accounts or computer systems or networks, through hacking, password mining or any other means. You shall not use any robot, scraper, malicious code, or other means to access our services.

If you receive any file from us or from a therapist or client, whether through the Platform or not, you agree to check and scan this file for any virus or malicious software prior to opening or using this file.

You agree to notify us immediately of any unauthorized use of your account or any other concern for breach of your account security.

You agree and commit not to violate any applicable local, state, national or international law, statute, ordinance, rule, regulation or ethical code in relation to your use of the Platform and your relationship with the therapists or clients and us.

You will indemnify us, defend us, and hold us harmless from and against any and all claims, losses, causes of action, demands, liabilities, costs or expenses (including, but not limited to, litigation and reasonable attorneys' fees and expenses) arising out of or relating to any of the following:

  • your access to or use of the Platform;
  • any actions made with your account or account access whether by you or by someone else;
  • your violation of any of the provisions of this Terms;
  • non-payment for any of the services ( which were provided through the Platform;
  • your violation of any third party right, including, without limitation, any intellectual property right, publicity, confidentiality, property or privacy right. This clause shall survive termination of the terms.

If you have a complaint about any of the content that may be published on the Platform, you should contact us.

Payment

You agree to pay all fees and charges associated with your account on a timely basis in accordance with the payment schedule made available in your profile. Such fees and charges (including any taxes and late fees, as applicable) may be charged to the payment method you choose. You agree to maintain valid payment information. By providing us with payment information, you authorize us to bill and charge your credit card or other payment method.

Regardless of any payments made, we shall not be considered as your direct provider of therapy services. Solely the therapists shall be considered as such providers.

You shall only use credit cards or other payment means which you are duly and fully authorized to use. All payment related information you have provided and will provide in the future, to or through the Platform, shall be accurate, current and correct and will continue to be accurate, current and correct.

Refunds for unused time are normally not granted since the therapists charge for time which is scheduled to be used. We will together with the Counsellor review refund requests on a case-by-case basis. In case the refund request is based on any special or legal circumstances, such as but not limited to medical, death, disability or court orders, we will make accommodations. In the case a refund is not granted or possible, we will be able to provide other accommodations, such as but not limited to helping you find a new therapist at no or a reduced cost and providing credit for future services. If you have any concerns about a bill or a payment, please contact us immediately by sending an email to support@realgoodhelp.com.

Money-back Guarantee

If a client is unhappy with their first session (trial or a regular session), they can get a full refund in the cases specified below.

We will refund the first session only, with a limitation to two therapists or coaches (so that one client can get a maximum of two sessions fully refunded). The client can only get a refund for the first session booked with therapists or coaches with the "money-back guarantee" badges clearly visible next to their profile picture.

How the Money Back Guarantee works: 1. Book a session with a therapist or coach with a "money-back guarantee" badge. 2. Complete your session. 3. If you are not satisfied with it, please send an email within 24 hours of the session to support@realgoodhelp.com. The email should include why you were dissatisfied with the session, its date and time, the name of the therapist, and your name. 4. We will review your request within three business days and confirm the refund. You will get your money back shortly after.

We are not making any guarantees about clients' ability to overcome or reduce the symptoms of their problems. We will not promise or guarantee results related to the client's mental health problems.

Therapists

We do not employ the therapists whose profiles are listed on the Platform. A therapist, and any individuals retained by them to use the Platform, are independent parties in relation to us. No employment relationship shall arise between such individuals and us.

We cooperate with independent, licensed or certified/accredited (depending on their location), and vetted professional therapists.Your relationship with your therapist is solely, and strictly, with the therapist and we shall not be involved in such a relationship.

The Platform is limited to allowing therapist services. The therapist is further liable for the therapist services provided by them.

Privacy

By agreeing to these Terms of Use, you also agree to our Privacy Policy available at https://wellbeing.host/realgoodhelppolicy .

Third Party Content

The Platform may contain other content, products or services which are offered or provided by third parties ("Third Party Content"), links to Third Party Content (including but not limited to links to other websites) or advertisements related to Third Party Content. We have no responsibility for such Third Party Content, including (but not limited to) any related products, practices, terms or policies, and we will not be liable for any damage or loss caused by any Third Party Content.

Linked Websites

The Platform may contain links to linked websites. Those links (including a button, hyperlink, or referral device of any kind) are provided for your use and convenience. We have no control over or rights in any linked websites that are not our own. While we make commercially reasonable efforts to ensure the Platform’s reliability and accessibility, you understand and agree that no platform can be 100% reliable and accessible and so we cannot guarantee that your access to the Platform will be uninterrupted or that it will be accessible, consistent, timely or error-free at all times.
